Bibliographie sélective OHADA

La présente contribution consiste à analyser les atteintes étatiques à certains droits et libertés fondamentaux dans le cadre de la lutte contre certaines infractions graves. Pour ce faire, il importe, d’abord, de chercher à identifier les dispositions des textes portant sur l’interception des communications électroniques et sur la répression de la cybercriminalité menaçant le droit au respect à la vie privée, au secret des correspondances dématérialisées et la liberté de pensée, d’opinion, d’expression et de presse. Ensuite, une fois ces dispositions identifiées, il sera question, dans une démarche prospective, d’envisager les mécanismes juridiques renforçant la protection de ces droits et libertés fondamentaux. This contribution consists of analyzing state infringements on certain fundamental rights and freedoms in the context of the fight against certain serious offences. In order to do so, it is important, first of all, to identify the provisions of the laws on the interception of electronic communications and on the repression of cybercrime that threaten the right to privacy and freedom of expression of citizens. Then, once these provisions are identified, it will be a question of trying to make them conform to the respect of fundamental rights and freedoms.
