Le travail décent est aspect important figurant par les droits économiques, sociaux et culturels en République Démocratique du Congo (RDC). Cependant, tout le monde peut accéder à cette prérogative sans discrimination en rapport avec la race, l’origine ou le handicap à condition de remplir les critères imposés pour le poste d’emploi. Cette étude analyse l’effectivité du droit au travail décent pour les personnes avec handicap en RDC, en confrontant les textes légaux, notamment la loi nº22/003 du 3 mai 2022 portant protection et promotion des droits de la personne avec handicap aux réalités sociales marquées par certains défis d’ordre institutionnel, social et économique. C’est dans cette optique que l’on se propose d’analyser la législation en vigueur ainsi que son application et d’identifier les principaux obstacles qui limitent l’accès au travail décent pour les personnes avec handicap en RDC. Pour y arriver, la dogmatique juridique est la stratégie mobilisée avec la technique documentaire et celle de l’interview libre. Ainsi, nous avons abouti aux résultats selon lesquels il se remarque la non-application de la loi en matière du droit au travail décent pour les personnes avec handicap en RDC, c’est ce qui justifie la persistance de la discrimination, les préjugés, difficulté d’accès à l’éducation ou la formation. Decent work is an important aspect among the economic, social, and cultural rights in the Democratic Republic of Congo (DRC). However, everyone can access this prerogative without discrimination based on race, origin, or disability, provided they meet the criteria imposed for the job position. This study analyzes the effectiveness of the right to decent work for persons with disabilities in the DRC, confronting legal texts, notably Law No. 22/003 of May 3, 2022, concerning the protection and promotion of the rights of persons with disabilities, with social realities marked by certain institutional, social, and economic challenges. It is in this perspective that we propose to analyze the existing legislation as well as its application and to identify the main obstacles that limit access to decent work for persons with disabilities in the DRC. To achieve this, legal dogmatics is the strategy employed along with documentary techniques and free interviews. Thus, we have concluded that there is a noticeable non-application of the law regarding the right to decent work for persons with disabilities in the DRC, which justifies the persistence of discrimination, prejudice, and difficulties in accessing education or training.
