Ships, the high-value asset used in both seagoing and inland navigation, and in which various legal and natural persons have interests, must be secured against legal risks arising from any cross-border legal divergence. Legal certainty of ownership of the ship is therefore desirable but it is under challenge with regard to the judicial sale of a ship: the effects of a judicial sale may be denied in a jurisdiction other than the place where it was sold under the principles of state jurisdiction. Multiple efforts have been made to address legal uncertainty. Particularly important is a new treaty governing the international effects of judicial sales: the United Nations Convention on the International Effects of Judicial Sales of Ships (Beijing Convention). This dissertation is intended to contribute to that process by setting out two tasks; first, it seeks to identify the obstacles to the recognition of foreign judicial sales, providing additional knowledge which may aid national legal orders when deciding recognition approaches; second, it looks for a universal solution that better guarantees recognition which would benefit shipping. A comparative legal research exercise exploring similarities and dissimilarities in the municipal and international laws governing the recognition and sale procedures is undertaken. Research results are presented in this kappa and research papers, exhibiting the profuse difficulties a party seeking recognition may encounter in the current legal framework, and explains the new recognition approach under the Beijing Convention. Based on the research findings, a universal solution is proposed that avoids révision au fond, defines the finality of a judicial sale, and sets forth a fixed number of grounds for denial of recognition which may bring greater certainty. This purported optimal solution should guarantee equal treatment for all foreign sales seeking recognition before the registry while minimising the registrar’s burden of finding and examining foreign laws. In the interest of universality, this solution better accommodates disagreeing principles underlying certain aspects of the sale, viz., the ship’s location at the time of sale, the notification of sale, and the variance in the standard sale, namely, court-approved private sales, in a manner that more states may accept. This solution is largely in line with the recognition approach under the Beijing Convention. Considering the greater legal certainty the new instrument may bring, ratification is supported.

The recent discoveries of natural resources on both territorial and maritime borders have heightened the probability of conflicts between states specifically in the Horn of Africa and the Greater Lakes Region. As a highly volatile region, conflicts are not a foreign phenomenon which have been plaguing the region since transition to the post-colonial era. It is simple to argue that the cause of disputes is due to the arbitrary borders drawn by the European powers, however, the region is experiencing a contemporary ‘scramble and petition’ with countries racing to exploit and gain over the newfound resources. In addition to this, the rise of nationalist sentiments combined with the burgeoning population and struggle of governments to finance their domestic budgets while trying to reduce borrowing from foreign markets due to the inflation costs which makes it expensive, also plays a key role in the quest to benefit from mineral exploration and excavation. While traditional conflicts rose from land border disputes that escalated to violence especially between border communities, maritime conflicts tend to be handled in legal ways with parties seeking intervention from bodies such as the International Tribunal of the Law of the Sea (ITLOS) and the International Court of Justice (ICJ). Most cases are solved by outright delimitation of the maritime borders rather that joint management of marine land masses or natural resources based on mutual understanding or mutually assured benefits. The recent Kenya-Somalia Maritime dispute is an excellent case study. The aim of this research is to not only show alternative dispute resolution methods that can be used in maritime border disputes but also analyse the switch from pacific means of settlement of disputes to judicial intervention of the court. It begins by looking at the evolution of land border disputes between the two states, touches on the maritime dispute and their diplomatic, economic and security relationship. It further critically analyses the points of view of the two countries and the court’s ruling. Finally, it examines alternative dispute settlement mechanism that could have been used.

Sovereign rights in Exclusive economic zones and Continental shelves are functionally limited to the economic exploitation of these zones. Moreover, in the case of disputed maritime zones these sovereign rights are neither exclusive nor necessarily constant. Nevertheless, states are still expected to provide the investments established in these zones the same treatment they should provide in their territories where they exercise full and constant sovereignty. If a host state agrees to the establishment of an investment in a maritime zone that become later contested, do the occurrence of the contestation and the hazards arising from such contestation relief the host state from its contractual and treaty obligations toward the investment by virtue of the force majeure concept. This paper argues that a traditional interpretation of the force majeure concept in respect of investment agreements and contracts, hampers states ability to de-escalate their maritime disputes, diminishes its capacity to conclude delimitation agreements and reduces the promotion of the UNCLOS III as well as its mechanisms for disputes settlement. It proposes a contextualist interpretation of the force majeure concept that is adapted to the exploitation of disputed maritime zones and states obligations under the international law of the sea. First, it examines the concept of force majeure as a doc-trinal hypothesis and its applications in international contracts and international in-vestment agreements. Second, it analyzes the legal act of maritime contestation as a force majeure event according to the possible interpretations of the concept of “force majeure”. Finally, it examines the recurrent legal implications susceptible of arising out of a contestation; provisional orders and unfavorable delimitation and their qualifica-tion as a force majeure event in the realm of investment agreements and contract.

Maritime transport is essential to the world’s economy and maritime arbitration plays a crucial role in maritime dispute resolution. Nowadays, many coastal jurisdictions have set up their own maritime arbitration institutions such as those in the US, the UK, Germany, Australia, China, Japan, Hong Kong, and Singapore. Building a national world-advanced maritime arbitration system as soon as possible to suit China’s rapid developments in shipping and international trading does not permit of any delay. How should China improve her laws, rules and institutions, including those for the enforcement of maritime arbitration awards, having regard to leading international maritime arbitration systems? It is posited that selective adaptation from the successful experience of other maritime arbitration systems is the most convenient and effective way to achieve such a goal. This adaptation will follow from a comprehensive and comparative study of the maritime arbitration laws, rules and the maritime arbitration institutions, including the laws relating to the enforcement of maritime arbitration awards, from these main global maritime arbitration centres in order to make China’s maritime arbitration more competitive at the international level. This thesis does not purport to cover every research field relating to maritime arbitration. Instead, as previously stated, it will focus only on the comparative study of some selected key issues of international commercial arbitration among the selected jurisdictions. A comprehensive study of international commercial arbitration or international maritime law is not the subject of this thesis. It should be noted further that this research basically concentrates on the practical problems of maritime arbitration practices, rather than taking an overly theoretical approach. The thesis selects the UK, the US, Singapore and Hong Kong as the target jurisdictions for comparison. Through selective comparative analysis of the key issues of maritime arbitration systems in the selected jurisdictions, which are internationally recognised as significant by many arbitration scholars, this thesis proposes that all these issues could conveniently be categorised into four key criteria; namely, fairness, confidentiality, efficiency and enforceability. It follows that the adaptations of the Chinese maritime arbitration system should mainly focus on these four criteria, as these are the most critical factors for the development of Chinese maritime arbitration system. Moreover, these four criteria should also have significance for other underdeveloped maritime arbitration systems. Also, based on these four key criteria, the thesis provides some specific suggestions on how the Chinese maritime arbitration system can be adapted to reflect other selected jurisdictions in the respects of some key issues of international commercial arbitration.

The shipping business is an important element for the life of the trade of the different countries of the world. It had a very important role in the past it still has and it will always have, as it is the cheapest means of transportation of goods. However, despite the importance of this element the legal complexities bom out of this business makes it a broad subject of study and research for the lawyers. This is because of the different documents used for the execution of the contract of transport by sea and because of the speed these deals are concluded and the different nationalities of the parties to the contract.
