Analiza la ordenación del mercado, la naturaleza jurídica y los interrogantes que desde el Derecho de la competencia plantea la actividad de Uber, Cabify y BlaBlaCar y de los conductores registrados en dichas plataformas. El primer capítulo examina el régimen jurídico del transporte discrecional de viajeros en vehículo de turismo, tanto público como privado, y de la intermediación en el transporte, en la normativa estatal y autonómica. En el segundo capítulo se determina la naturaleza jurídica de la actividad de las plataformas de transporte y de los conductores registrados en las mismas. El tercer capítulo se centra en el análisis de los modelos de negocio de las plataformas desde la óptica de la Ley de competencia desleal y, en concreto, si existe infracción de su artículo 15; mientras que el cuarto y último capítulo examina si las mismas incurren en una conducta colusoria de fijación de precios (art. 101.1 TFUE y art. 1.1 LDC). The doctoral thesis analyses the market regulation, the legal status and the questions that the activity of Uber, Cabify and BlaBlaCar and their registered drivers raise from a Competition Law point of view. The first chapter explores legal regime of public and private occasional transport of passengers by car, and lays out the regulation of transport intermediation activities, at State, autonomic and local level. The second chapter addresses the legal nature of transport platforms activity, as well as that of the drivers registered on said platforms. The third chapter analyses the business models of the platforms from the perspective of Unfair Competition Act, and, in particular, whether they infringe its Article 15; whereas the fourth and last chapter aims to determine if the platforms incur in a collusive price-fixing conduct [Art. 101(1) TFEU and Art. 1(1) DCA].
