Cette étude est consacrée à l'influence du droit français sur le droit des contrats des États-Unis à partir du XIXe siècle et jusqu'à nos jours. La présente recherche vise à montrer que, bien que les États-Unis soient les héritiers de la tradition juridique de la common law anglaise, les droits continentaux, notamment, le droit français, ont apporté une grande contribution dans le développement du droit moderne des contrats aux États-Unis. Le sujet est abordé dans le temps passé et présent. D'une part, nous examinons le rôle du droit français des contrats au XIXe siècle et surtout à partir de 1860, autrement dit, pendant la période marquée par la codification du droit civil dans les différents États américains. D'autre part, nous nous attarderons sur la situation récente et contemporaine afin de confirmer la persistance des emprunts américains au droit français et leur actualité, mais aussi afin d'étudier l'influence des approches et des méthodes du droit français dans la codification américaine au niveau fédéral. Notre étude s'inscrit dans le processus d'analyse de l'ensemble du droit continental qui a rayonné significativement sur le sol américain dans le passé, mais peu observable aujourd'hui. Parmi les autres droits continentaux, le droit français connu le plus grand succès à cause de sa fidélité au droit romain et à son expérience réussie de codification. La réalisation de notre projet nous permettra d'identifier les emprunts faits au droit français, de suivre leur évolution au sein du droit américain des contrats, et de retracer les liens juridiques entre les États-Unis et la France. This study is devoted to the influence of French law on the United States contract law from the 19th century to the present day. This research aims to show that, although the United States is the heir to the legal tradition of English common law, the continental law (in particular, French law) made a noticeable contribution to the development of the modern contract law of this country.The subject is approached in the past and present times. On one hand, we examine the role of French contract law in the 19th century, and especially from 1860, in other words, during the period marked by the codification of civil law in various American states. On the other hand, we focus on the recent and contemporary situation not only to confirm the persistence of American borrowings from French law and their relevance, but also to study the influence of these approaches and methods of French law on American codification at the federal level. Our study is part of the analysis of the whole continental law which had a significative impact on American soil in the past, but which is hardly observable today. Among the other continental laws, French law had the greatest success because of its fidelity to Roman law and its successful codification experience. The realization of our project will allow us to identify the law influences derived from French law, to follow their evolution within American contract law, and to trace the legal connections between the United States and France.
