Le sort du contrat déséquilibré par l’imprévision a évolué avec l’avènement de l’Avant-projet de texte uniforme portant droit général des obligations. Cet instrument juridique prévoit à la suite des législations anationales et certaines législations nationales la révision du contrat pour imprévision. Dans ce mécanisme de gestion de l’imprévision, les parties au contrat ont une place préférentielle. Ce n’est qu’en cas d’échec d’une gestion amiable de l’imprévision que le juge est habilité à intervenir. The fate of a contract unbalanced by unforseen circumstances has evolved with the advent of preliminary draft uniform text on general law of obligations. This legal instrument provides, following international laws and certain national laws, for the revision of the contract for unforseen circumstances. In this unforseen management mechanism, the parties to the contract have a preferential place. It is only in the event of failure of an amicable management that the judge is authorized to intervene.
