Reflections on legal complexities in the liquidation of microfinance institutions in CEMAC
Résumé
The CEMAC legislator sets out via Regulation No 02/14/CEMAC/UMAC/COBAC of 25th April 2014 on the management of credit institutions in difficulty to ensure harmonisation of liquidation operations for credit institutions and microfinance institutions. However, the co-existence of a dual regime for liquidation operations makes the procedure cumbersome and complex. The latter is glaring in the distinction of the assets of a MFI into different compartments. Adopting the doctrinal research method, the paper sets out to critically examine the complexities in liquidation operations inherent in the 2014 regulation. It reveals that the co-existence of the banking and non-banking compartments render liquidation operations cumbersome, and recommends the adoption of a regulation that is specifically adapted to the management of liquidation operations in MFIs.
